Really sharp piece on the structural issue here. The legal fiction angle is somethig I hadn't fully considered before but it makes sense. Once you allow documents to contradict biological reality in this one category, it ripples out into everyother institutional space that depends on those documents being accurate. I actualy saw this play out at an airport where the screening process got totally confused, kinda like the TSA example here. The whole system breaks when one category becomes subjective while everything else stays objective.

Brillant structural analysis here. The insight about legal sex change as the foundational lever makes total sense becuase once the law treats subjectivity as objective reality, every downstream institution gets forced to play along. I ran into this exact issue at my old workplace where we couldnt even have basic convos about sex-specific medical needs without HR freaking out.

Great piece and I agree that the legal definition of sex is the heart of the hydra as recognised by Kellie-Jay Keen when she erected her adult human female billboard (which was taken down within 48 hours) in 2018. Hopefully Trump's executive orders and the DHHS report in the States and the Supreme Court judgment in the UK have blown a hole in the hydra's heart ( hence some of the violent kickback).

we just call it hhs here. and yes, hhs and doe (dept of education) are really throwing down the gauntlet, plus they did it straight out of the gate so it has a chance to be settled and harder to roll back by end of trump term

Interesting that I should come across this. Thank you for articulating your thoughts here so well. I’ve sat pondering the heart of the Hydra now for several weeks, with that exact same analogy. And the beast has many heads. Wrestling with all the heads, and seeing others do the same, with little success, I had to start wondering what is at the heart of it. Thanks for writing this. 🙏🏻

Yup. That's it.

And once a society agrees to this epistemological sleight of hand, everything is up for grabs. Sex is fixed in utero. That's it! You can have any gender you want. Even put that gender on your passport.

But of course they'd fight that tooth and nail.

This is such a pit of vipers...
